Terms of Service

1. Scope of Application

These Terms of Service apply to all orders placed through our online shop at gartengeraete-shop.us. By placing an order, you agree to these terms. We only sell to customers who are at least 18 years old.

3. Offer and Contract Conclusion

The presentation of products in our online shop constitutes a non-binding invitation to place an order. By clicking the "Order" button, you submit a binding offer to purchase the goods in your shopping cart. We will confirm receipt of your order by email. The purchase contract is concluded when we accept your order by sending a shipping confirmation or delivering the goods.

4. Prices and Shipping Costs

All prices are quoted in US Dollars ($) and include applicable sales tax unless otherwise stated. Shipping costs are calculated based on weight and destination and are displayed before order completion. We reserve the right to correct pricing errors.

5. Payment Methods

We accept PayPal, Visa, Mastercard, American Express, Apple Pay, Google Pay, and bank transfer. Payment is due immediately upon order placement. For bank transfers, goods will be shipped after payment receipt.

6. Delivery

Delivery times are stated on the respective product pages. Unless otherwise specified, delivery within the continental United States takes 3-7 business days. We ship via DHL, UPS, and FedEx. Risk of loss passes to the customer upon delivery to the carrier.

7. Retention of Title

Goods remain our property until full payment has been received.

8. Warranty

We provide a statutory warranty for defects in accordance with US consumer protection laws. Please report any defects within 14 days of delivery. Manufacturer warranties apply in addition where provided.

9. Limitation of Liability

We are fully liable for intent and gross negligence. For slight negligence, we are liable only for breach of essential contractual obligations, limited to foreseeable, typical damages. This limitation does not apply to injury to life, body, or health.

10. Governing Law and Jurisdiction

These terms are governed by the laws of the State of Washington, USA. The exclusive place of jurisdiction for all disputes arising from this contract is Whatcom County, Washington.

11. Severability

Should any provision of these terms be invalid, the remaining provisions shall continue in full force and effect.
